IK-IP celebrates success in European Patent Opposition

Three of our IP-Experts attended oral proceedings before the Opposition Division of the European Patent Office last week and were successful in seeing the opposed patent revoked in its entirety.

On Friday 9th October IK-IP attended inter partes oral proceedings before the Opposition Division of the European Patent Office and were successful in convincing the Opposition Division to revoke a patent we'd challenged in its entirety.

The opposition to the patent was filed in July 2025 at the end of the 9 month opposition period to which all granted European patents are subject. IK-IP presented arguments on insufficiency of the disclosure, impermissible added matter, and lack of novelty and inventive step. While assessing the validity of the patent, the team had found a number of relevant prior publications which had not previously been reviewed by the patent examiner who had allowed the patent to grant.

During the 8 hour long proceedings the team saw the granted claims of the patent revoked, the patent owner submitted 23 alternative claim requests with a view to overcoming the issues raised by the IK-IP team. The team were successful in rebutting each request on a range of grounds including added matter, lack of clarity, lack of novelty and lack of inventive step.

The challenged patent was one of a small portfolio directed to determining parameters of a user's eye using cameras positioned in a head-wearable device (such as spectacles) to capture images of eye reactions to stimuli, and in this patent focus was on the use of a neural network trained on pre-captured images to determine a parameter from a live captured image. This was the team's second success against the patentee on this portfolio, in February 2026 they successfully saw the granted claim set revoked and 99 alternative claim requests rejected.
